Labour’s proposed overhaul of the gender transition process and political clash with Scottish Greens and Conservatives has sparked a nationwide debate. Here’s the full story.
Labour’s Gender Transition Pledge
The Labour Party have reiterated its pledge to modernise the gender transition process in the UK, focusing on removing outdated elements that currently complicate the process.
Removing Spousal Consent
Key among these changes is the elimination of the requirement for spousal consent and the need for individuals to present evidence of living in their new gender for two years. Instead, Labour proposed a reflection period of the same duration.
Documentation Trail Removed
One of the most significant changes proposed by Labour is the removal of the two-year documentation trail needed to seek a GRC. Individuals must show evidence from various sources, including official documents, payslips, and letters, over two years.

This requirement would be replaced with a reflection period, eliminating the need for extensive documentation. Additionally, Labour plans to replace the panel of doctors and lawyers who currently approve GRCs with a single doctor specialising in gender issues, ensuring a more focused and medical approach to gender dysphoria diagnosis.
“Modernise, Simplify, Reform”.
A spokesperson for the party stated that their proposed changes would “modernise, simplify and reform the intrusive and outdated gender recognition law to a new process. We will remove indignities for trans people who deserve recognition and acceptance; while retaining the need for a diagnosis of gender dysphoria from a specialist doctor, enabling access to the healthcare pathway.”
Tolerance and Protection
The statement continued, “Britain is a reasonable and tolerant society where most people know that there are a small number of individuals who do not identify with the gender that they were born into. Labour’s plans will protect single-sex spaces, treat everybody with respect and dignity, maintain the existing two-year timeframe for gender recognition, and ensure that robust provisions are in place to protect legitimate applications.”
JK Rowling’s Pushback
The announcement of Labour’s plans led to significant pushback from author JK Rowling, a former Labour member and donor, who expressed concern over the party’s stance on transgender rights.

In the Times, Rowling claimed she had a “poor opinion” of Starmer and stated, “as long as Labour remains dismissive and often offensive towards women fighting to retain the rights”.
Starmer’s Response
Labour leader Keir Starmer responded to Rowling’s comments, stating, “I do respect her but I would point out the long record that Labour has in government of passing really important legislation which has advanced the rights of women and made a material difference.”
Gender Rights Debate
However, the issue of transgender rights has become increasingly contentious during the general election campaign, bringing Scotland’s recent Gender Reform Bill into the spotlight.

Holyrood passed the bill with overwhelming support, intending to simplify legally changing gender. However, the UK government blocked the bill, citing conflicts with the Equality Act.

This move marked the first time a Scottish law was halted for affecting UK-wide legislation. The Scottish Greens and SNP criticised the block as an attack on transgender rights and Scottish devolution, urging the next UK government to lift the veto.

The Scottish Greens described the UK government’s action as a “disgraceful attack” on transgender rights, calling for the veto to be lifted to allow trans people to live without unnecessary medical and screening processes.

Speaking at the Edinburgh Pride parade, Maggie Chapman, the Scottish Greens equalities spokesperson, stated, “I don’t think it’s appropriate that one man can overturn and veto a bill that has been legitimately and democratically passed by our Parliament. That’s why the Scottish Greens are calling on the next UK government to lift the veto… so trans people can get to live as they are, without having to go through medical and screening processes.”
Scottish Conservatives’ Defence
Meanwhile, the Scottish Conservatives defended the block, with deputy leader Megan Gallacher stating, “The SNP have wasted hundreds of thousands of pounds of taxpayers’ money taking the UK government and others to court over issues related to gender.”
Women’s Rights Concerns
She continued, “I think a lot of women and girls will feel their rights are not being upheld and protected here in Scotland and that is something that the Scottish Conservatives will not shy away from. We’re not going to support dangerous policies such as self-identification which the SNP, Labour, the Liberal Democrats and the Greens tried to push through the Parliament.”
SNP’s Stance
While supporting the reform bill, the SNP acknowledged that the issue might not be a priority immediately after the election due to other pressing challenges such as austerity, Brexit, and the cost of living.
Scottish Labour’s Pressure
Scottish Labour, which initially backed the bill, also faced internal pressure. Leader Anas Sarwar stated, “We’ve been very clear throughout this process that when we supported the legislation it was on the basis that it would not negatively impact on the equality act. That was the cast iron guarantee given by the SNP government which has now not proven to be the case.”
Trans Community Tragedy
He added, “The tragedy in all of this is that, since the passing of that legislation, our trans community feel no more protected and women feel no more reassured.”
Culture War Debate
The constant equating of transgender rights as an attack on women’s rights, and vice versa, has turned the issue not just into a culture war debate fuelled by figures like Rowling but also into a devolution issue, as the Scottish Parliament’s legitimacy has been called into question.

However, despite the divisiveness of the debate, it remains to be seen if gender reform will be a decisive factor in the upcoming elections.
